IF INFORMAL RESOLUTION IS UNSUCCESSFUL, DISPUTES SHALL BE RESOLVED THROUGH BINDING ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. INJUNCTIVE RELIEF MAY BE SOUGHT IN ANY COURT OF COMPETENT JURISDICTION.
CLASS ACTION WAIVER: TO THE EXTENT PERMITTED BY LAW, YOU AND Home and Living AGREE TO RESOLVE ALL DISPUTES INDIVIDUALLY, AND NOT AS PART OF A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Legal Jurisdiction
This Agreement is governed by the laws of the State of New Jersey, excluding its conflict of laws provisions. Nothing contained in these Terms is intended to, or shall, abridge any rights you may have under applicable state or federal privacy statutes.
